PROTECTION OF PERSONAL DATA

As part of its commercial activity, the Walomo group collects and processes the personal data of its users (hereinafter the “Users”).

This privacy policy, implemented by Walomo, aims to provide Users with a concise and comprehensive overview of the personal data processing operations carried out by Walomo.

Walomo places great importance on respecting the privacy of Users and the confidentiality of their personal data, and thus commits to processing the data in compliance with applicable laws and regulations, notably Law No. 78-17 of January 6, 1978, relating to information technology, files, and freedoms (hereinafter the “Data Protection Act”), and Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter the “GDPR”).

Definitions

Personal Data : Personal data is any information relating to an identified or identifiable natural person, meaning one who can be identified, directly or indirectly, by reference to an identification number or to one or more factors specific to them.

Processing of Personal Data : Processing of personal data is any operation or set of operations performed on such data, regardless of the process used, including collection, recording, organization, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination, or otherwise making available, alignment or combination, as well as locking, erasure, or destruction.

Cookie : A cookie is information stored on an internet user's hard drive by the server of the site they visit. It contains several pieces of data: the name of the server that placed it, a unique identifier in the form of a number, and possibly an expiration date. This information is sometimes stored on the computer in a simple text file that a server accesses to read and record information.

Data Controller – DPO

The data controller for the personal data referred to herein is Walomo SARL, registered with the RCS of Bobigny under number 330 354 614, with its registered office located at 70 rue de la Perdrix, 93290 Tremblay, France.

Walomo has appointed a Data Protection Officer (DPO) with the CNIL, who can be contacted at any time for any request regarding the processing of personal data by the company at the following address: dpo@Walomo.com.

Data Collected

Walomo collects data from Users to provide them with the services they have subscribed to on the platform.

The mandatory or optional nature of the data provided (in order to finalize the User's registration and provide them with Walomo's offers and services) is indicated at the time of collection by an asterisk.

Furthermore, some data is collected with the user's consent due to the user's actions on the site (see the section on cookies).

Purposes

The personal data collected by Walomo in the course of providing services are necessary for the performance of contracts concluded with the User, or to enable Walomo to pursue its legitimate interests while respecting the User's rights. All of this personal data is processed based on the User's consent.

The purposes for which Walomo processes data are as follows :

- Commercial and accounting management of the contract;
- Management of activation and marketing activities;
- Detection of malicious behavior (fraud, phishing, spam, etc.);
- Improvement of user experience on the site;
- More generally, any purpose mentioned in Article 2 of Resolution No. 2012-209 of June 21, 2012, establishing a simplified standard concerning the automated processing of personal data related to user and prospect management.

Recipients of the Data

The personal data collected is intended for the commercial and accounting departments of Walomo. It may be transmitted to Walomo subsidiaries or subcontractor companies that Walomo may use in the performance of its services.

In this context, personal data may be transferred to a country within or outside the European Union. The user will be systematically informed and their explicit consent will be obtained. Walomo implements safeguards ensuring the protection and security of this data, in compliance with regulations.

Walomo does not sell or rent personal data to third parties for marketing purposes.

However, the disclosure of personal data to third parties may occur in the following cases:

- With their authorization;
- At the request of legally competent authorities, by judicial requisition, or as part of a judicial proceeding.

Data Retention Period

To meet its legal obligations or to have the necessary elements to assert its rights, Walomo may archive data under the conditions provided by regulation.

Thus, personal data collected by Walomo related to the identity and contact details of its Users are archived for a maximum duration of ten years after the end of the contractual relationship for client Users, or from their collection by the data controller or the last contact from the prospective User for data related to the latter.

The end of the contractual relationship is understood as the explicit termination of the contract by the User.

User Rights

In accordance with regulations, the User has rights to access and rectify personal data concerning them, allowing them to correct, complete, update, or delete data that is inaccurate, incomplete, ambiguous, outdated, or whose collection, use, communication, or storage is prohibited.

The User also has the rights to request the restriction of processing and to object to the processing of their personal data for legitimate reasons. The User can also provide instructions on the handling of their personal data in the event of their death.

Where applicable, the User can request data portability or, where the processing is based on consent, withdraw their consent at any time.

The User can exercise their rights by emailing dpo@Walomo.com.

The User can also modify their data themselves at any time by logging in at https://www.Walomo.com and clicking on "my account" or by contacting customer service at dpo@Walomo.com.

The User can unsubscribe from the Walomo newsletter or marketing emails by following the unsubscribe links included in each email.

In case of dispute, the User can file a complaint with the CNIL, whose contact details can be found at http://www.cnil.fr.

The User can access detailed information on the use of their personal data, including the purposes of processing, the legal bases allowing Walomo to process the data, their retention periods, their recipients, and, where applicable, transfers to a non-EU country and the safeguards implemented. To do so, the User can send a request by email to dpo@Walomo.com.
